SMS communications terms of service

These terms govern how Base Power Company and its affiliated entities, including Base Power, Inc., Base Texas REP, LLC, Base Power Development, LLC and Base Retail, LLC, send text messages (SMS/MMS) to members and prospective members. By opting in to receive messages from us, you agree to these terms.

These terms apply to all Base Power SMS programs across every state in which Base Power operates, including Texas, Illinois, and any other jurisdiction where Base Power or its affiliates hold a license or operate a service.

1. Program description

Base Power uses SMS/MMS to communicate with members and prospective members about their accounts and services. Messages may include, but are not limited to:

  • Account and energy service notifications, activation status, billing, payment confirmations, and service updates
  • Battery installation, scheduling, and service updates
  • Outage alerts and grid-balancing event notifications
  • Responses to member support requests
  • Renewal notices and plan expiration reminders
  • Promotional offers and announcements (only where you have separately consented)

2. How to opt in

Base Power sends two types of SMS communications, each with its own consent standard:

Transactional messages (installation coordination, meeting reminders, account status, billing, service updates, outage alerts, support responses). By providing your phone number during signup and completing our sign-up form, you consent to receive service-related texts and calls from Base Power. This consent is limited to non-marketing, transactional communications necessary to service your account.

Marketing messages (promotional offers, new product announcements, member-only deals, seasonal content). You must separately opt in by checking the marketing consent checkbox on our sign-up form. Providing your phone number alone does not constitute consent to receive marketing messages. Marketing SMS consent is always optional and separate from any purchase or service agreement with Base Power.

By opting in to either program, you confirm that you are the account holder or authorized user of the mobile number provided and that you are 18 years of age or older.

3. How to opt out

Reply STOP to any message from us to unsubscribe immediately.

After receiving your STOP request, we will send one confirmation message and stop all further messages to that number. No additional messages will be sent unless you re-subscribe.

You may also opt out by contacting member support at support@basepowercompany.com or calling the number on your member account. Opting out of SMS does not affect your energy service, battery service, or any other agreement with Base Power.

To resubscribe at any time, reply START or UNSTOP to any Base Power message, or visit basepowercompany.com to opt in again.

4. Help

Standard member support hours are Monday through Friday 9:00 AM to 6:00 PM Central Standard Time.

5. Message frequency

Message frequency varies. Transactional messages, billing alerts, service updates, and outage notifications are sent as events occur. Promotional messages are sent only as needed. We do not send unsolicited bulk promotional messages.

6. Message and data rates

Message and data rates may apply depending on your mobile carrier plan. Base Power does not charge a separate fee for SMS. Contact your carrier if you have questions about your plan.

7. Carrier liability

Mobile carriers are not responsible for delayed or undelivered messages. Delivery depends on carrier network conditions. Base Power is not responsible for messages that are delayed or not delivered due to carrier issues.

8. Privacy and data use

Base Power collects your mobile number and SMS consent solely to deliver the communications described in these terms.

Text messaging opt-in data and consent will not be shared with, sold to, or transferred to any third party for independent marketing purposes.

Your mobile number may be shared with Base Power’s SMS service providers and telecommunications carriers only as necessary to deliver messages. Those providers are prohibited from using your information for any other purpose.

9. Compliance

Base Power’s SMS programs comply with applicable federal and state law, including the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, and applicable state consumer protection statutes. These terms apply uniformly across all jurisdictions in which Base Power and its affiliates operate.

Base Power does not send messages involving prohibited content categories as defined by U.S. mobile carriers

10. Changes to these terms

We may update these terms at any time. The effective date above reflects the most recent update. Continued receipt of SMS messages from Base Power after an update constitutes acceptance of the revised terms. You may opt out at any time as described in Section 3.

Base Retail, LLC is not the same entity as your electric delivery company. You are not required to enroll with Base Retail, LLC. Beginning on June 1, 2026, the electric supply price to compare is 10.399¢/kWh. The electric utility electric supply price will expire on September 30, 2026. The utility electric supply price to compare does not include the purchased electricity adjustment factor. Base Retail, LLC is an independent seller of electric power and energy service certified by the Illinois Commerce Commission. Base Power is not representing, endorsed by, or acting on behalf of any utility, utility program, consumer group, or governmental body.

In Colorado, Base offers home battery equipment and installation. Base is not an electric utility or a retail electric supplier in Colorado.
